The purpose of these conditions is to define the terms and conditions of sale between “the seller”, the Maison Tika company, and the customer via the maisontika.fr website, from the order to the services, including payment and delivery. They govern all the steps involved in placing an order and ensure the follow-up of the order between the contracting parties.
APPLICATION AND ENFORCEABILITY OF THE GENERAL TERMS AND CONDITIONS
All orders placed on the maisontika.com site are subject to the present general terms and conditions, acceptance of which constitutes a determining element without which the seller would not have entered into a contract. Any placing of an order implies and constitutes the express and unreserved acceptance of these terms and conditions, which the customer has read before placing an order on the maisontika.com site, where they can be consulted directly.
The seller reserves the right to modify its terms and conditions at any time. In this case, the applicable conditions will be those in force at the date of the order or of the express acceptance of the order (date and time of Paris - France). The fact that the seller does not take advantage, at a given moment, of any of these stipulations shall not be interpreted as a renunciation to take advantage of them at a later date.
ORDER
Confirmation of the order by the customer on the maisontika.com site constitutes signature, acceptance of the operations and contract. All data entered by the customer, as well as the order confirmation, will constitute proof of the transaction. A summary of the order information and the present general terms and conditions will be sent to the customer by e-mail, to the e-mail address used to confirm the order. The customer is reminded that the seller prefers to keep small quantities in stock, and that items ordered are made to order. Accordingly, the seller undertakes to honour orders received on its site only within the limits of available product stocks. In the event of product unavailability, the seller undertakes to inform the customer, but cannot be held responsible for the cancellation of an order due to unavailability. In the event of unavailability of one of the materials required to manufacture the item as described on the maisontika.com website, the seller undertakes to contact the customer to inform him of this, and to offer to replace the missing color or pearl with another. The seller reserves the right not to register a payment and not to confirm an order for any reason whatsoever, particularly in the event of a supply problem or difficulty concerning the order received.
WITHDRAWAL
In accordance with the provisions of articles L.221-18 et seq. of the French Consumer Code, the customer has a period of 14 days from receipt of the products to exercise his right of withdrawal without having to justify his reasons or pay any penalties. Within this period, the customer must send a return request by e-mail to the following address maison.tika@gmail.com pour que le vendeur valide cette demande.
Returns must be made by the customer within fourteen days of informing us of their decision to cancel, in their original condition and complete with packaging and accessories. The return costs are at the seller's expense: after receipt of the return request, the seller will send the customer a return label by e-mail, to be printed and used to return the product.
In the event of the customer exercising his/her right of withdrawal, the seller reserves the right to defer reimbursement until recovery of the goods or until the customer has provided proof of shipment of the items, whichever comes first. The seller will make this refund using the same means of payment as that used by the customer for the initial transaction, unless the customer expressly agrees to use another means of payment and insofar as the refund does not incur any costs for the customer.
The seller is not obliged to reimburse additional costs if the customer has expressly chosen a delivery method that is more expensive than the standard delivery method offered by the seller. Any damage suffered by the product on this occasion may be such as to defeat the right of withdrawal. The seller reserves the right to accept or refuse the returned item depending on its condition, and in this case not to reimburse it.
PRODUCTS - EXCLUSIONS
Only the products mentioned in the orders confirmed in accordance with article III above are subject to the seller's obligations. The products offered for sale are those described on the site on the day the customer consults the site, subject to availability. This information is updated automatically in real time. However, the seller cannot be held responsible for any error or delay in updating, whatever the cause. The seller takes the utmost care in the presentation and description of its products in order to provide the customer with the best possible information. However, it is possible that errors may appear on the site, which the customer acknowledges and accepts. It is also possible that the customer may receive, following an order, a part previously returned by another customer, which the customer acknowledges and accepts, without being able to question the order in this respect, it being specified that the seller only accepts the return of products that are intact, tried on but not worn, and that these conditions are verified before the returned products are put back into stock.
EXCHANGES AND REFUNDS
With the exception of legal provisions relating to the right of withdrawal, the seller is under no obligation to accept customer requests for exchange or refund. In this case, all requests for exchange or refund must be sent by e-mail to maison.tika@gmail.com by the customer, who must indicate his or her surname, first name, telephone number, order number and the reason for the return.
If the seller accepts the request for exchange or refund, the postal return address will be sent by e-mail to the customer, who must then return each item complete (packaging, accessories), in its original condition and in its original packaging, with its return number included in the parcel, giving a certain date to this shipment. In the event of a return that is not made within 14 days (legal retraction period) or that is not made for a reason acceptable to the seller, the return costs will be borne by the customer.
No COD returns will be accepted for any reason whatsoever.
In the event of an exchange in France (and only in the event of an exchange due to an error), the shipping costs of the second shipment will be offered to you, if and only if the error originates from the seller with regard to the product ordered and/or its quality. If the return is justified by an error on the part of the customer as to the size of the order, or by a misjudgment as to color, texture, cut or, more generally, visual rendering, the seller will not be held responsible and the cost of the second shipment will be borne by the customer.
SHIPPING
The seller delivers to France and most European countries. Orders are dispatched to the address shown on the electronic invoice issued when the order is confirmed, based on the information supplied by the customer, within the time indicated on the order confirmation page.
Delivery times, which only begin to run on the day the order is validated and paid for, are given for information only, and failure to meet them shall not give rise to deductions, compensation or damages, nor justify the cancellation of orders in progress. Deliveries are made according to stock availability and supply lead times, subject to any technical difficulties. The seller cannot be held responsible for delays in delivery due to our supply, nor can it be held responsible for penalties or damages of any kind due to a delay or non-delivery in the event of force majeure or fortuitous event.
PRICE
The prices of our products are indicated in euros, exclusive of tax, as the seller is not subject to VAT. Orders, whatever their origin, are payable in euros.
